Mining giant BHP Billiton has been denied leave to appeal an asbestos compensation case in the High Court of Australia.
Perth man Willem van Soest brought a claim against the company in 2012 after being diagnosed with mesothelioma, and died of the cancer the following year aged 74.
Turner Freeman Lawyers partner Annie Hoffman, who represented Mr van Soest, successfully argued his cancer was caused by his exposure to loose asbestos fibres when he spent 11 weeks working as a painter and docker at BHP Billiton’s Whyalla shipyard in 1962.
